Acceptance of Terms

By creating an account or using MintCast, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you may not use our service. If you are using MintCast on behalf of a business or organization, you represent that you have the authority to bind that entity to these Terms.

Description of Service

MintCast is a cloud-based digital signage management platform that allows businesses to remotely manage content displayed on TV screens, digital displays, and signage devices. Our service enables you to upload, schedule, and display content across multiple screens from a centralized dashboard.

Account Registration

To use MintCast, you must:

• Provide accurate and complete business information during registration
• Maintain only one account per business entity
• Keep your login credentials secure and confidential
• Notify us immediately of any unauthorized access to your account

You are responsible for all activities that occur under your account.

Free Trial

MintCast offers a 14-day free trial with full feature access. No credit card is required to start your trial. At the end of the trial period, you must subscribe to a paid plan to continue using the service. If you do not subscribe, your access to the service will be suspended.

Subscription and Billing

Our pricing is as follows:

• ACH/Bank Transfer: $5 per screen per month
• Credit Card: $10 per screen per month
• Annual Billing: Available at a discounted rate (2 months free)

Subscriptions automatically renew at the end of each billing period unless cancelled. You may cancel your subscription at any time, effective at the end of your current billing period. We do not provide refunds for partial billing periods.

Acceptable Use

You agree not to use MintCast to display content that is:

• Illegal, harmful, threatening, abusive, or harassing
• Obscene, pornographic, or sexually explicit
• Defamatory, libelous, or invasive of privacy
• Infringing on copyrights, trademarks, or other intellectual property rights
• In violation of any applicable law or regulation

We reserve the right to remove any content that violates these Terms and to suspend or terminate accounts that repeatedly violate our acceptable use policy.

Content Ownership

You retain full ownership of all content you upload to MintCast. We do not claim any intellectual property rights over your content. We only store and display your content as directed by you to provide our service. Upon account termination, your content will be deleted within 30 days.

Intellectual Property

The MintCast name, logo, software, and platform are the property of MintCast LLC. You may not copy, modify, distribute, sell, or lease any part of our software or services without our prior written consent.

Service Availability

We strive to maintain high availability of our service but do not guarantee 100% uptime. Scheduled maintenance will be communicated in advance when possible. We are not liable for any downtime caused by factors outside our reasonable control, including internet outages, hardware failures, or force majeure events.

Limitation of Liability

MINTCAST IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE MAXIMUM EXTENT PERMITTED BY LAW, MINTCAST LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM YOUR USE OF THE SERVICE SHALL NOT EXCEED THE TOTAL FEES PAID BY YOU IN THE 12 MONTHS PRECEDING THE CLAIM.

Indemnification

You agree to indemnify and hold harmless MintCast LLC, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorney fees) arising from your use of the service, your content, or your violation of these Terms.

Termination

Either party may terminate this agreement at any time. You may cancel your subscription from your account dashboard. We may terminate or suspend your access immediately, without prior notice, for violation of these Terms. Upon termination, your right to use the service ceases immediately, and your data will be deleted within 30 days.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Montana, United States, without regard to its conflict of law provisions.

Dispute Resolution

The parties agree to attempt to resolve any disputes informally before initiating formal legal proceedings. Any legal action or proceeding arising out of or relating to these Terms shall be filed exclusively in the state or federal courts located in Flathead County, Montana, and you consent to the jurisdiction of such courts.

Changes to Terms

We may modify these Terms at any time. If we make material changes, we will notify you by email at least 30 days before the changes take effect. Your continued use of MintCast after the effective date constitutes acceptance of the modified Terms.
